Protecting our Heritage- Enforcement Policy and Practice

This in person day course provides an introduction to policy, practice and awareness of issues around enforcement in relation to the historic environment. Although formal enforcement action in England appears to be low, this CPD event will aim to discuss, with participants, why this is the case and where impediments to effective action can be overcome to foster more successful outcomes.

The session will cover.

– Review of powers under the 1990 Act;
– Relevant Policy including the NPPF
– Interaction with enforcement officers & and briefing of prosecution solicitors;
– Complimentary skills Writing offence reports; written evidence: structure, evidence and documentation;
– Heritage Crime – Guidance for Sentencers
– The role of councillors and delegated powers;

This CPD is relevant to historic environment professionals, local authority enforcement officers and others involved in tackling all aspects of historic environment planning contraventions.

The course is provided by Bob Kindred and will comprise two sessions:
Session 1
– Resources;
– Past policy and the NPPF;
– Offences, current penalties and simple proof;
– Local authority activity – and reasons for inactivity; prioritisation for the planning authority;
– 10 case examples with different aspects of success and failure and provide a ten-point guide to effective case management.
Session 2
– Discussion (of a specific case) to tease out a forensic approach;
– Defences under the 1990 Act; cautions; Listed Building Enforcement Notices;
interaction with enforcement officers & complimentary skills; briefing of prosecution solicitors;
– Writing offence reports; written evidence: structure, evidence and documentation;
– Heritage Crime – Guidance for Sentencers; The role of councillors and delegated powers; The calibre and background of magistrates;
